Terms of Service

These Terms of Service are effective as of November 12, 2025.

§ 1. General Provisions

These Terms of Service define the rules for using the MasterPhrase platform, available at the internet address https://masterphrase.com/, run by Digital Source Marcin Sadowski with its registered office in Warsaw (01-164), at ul. Radziwie 3/67, NIP: 4990370530, REGON: 320563942, contact e-mail: support@masterphrase.com.
By using the MasterPhrase service, the User accepts these Terms of Service and undertakes to comply with them.
The Terms of Service constitute a regulation for the provision of electronic services within the meaning of the Act of July 18, 2002, on the provision of electronic services.

Service Provider - Digital Source Marcin Sadowski, conducting business activity under the name Digital Source Marcin Sadowski.
Service - a service provided electronically by the Service Provider to the User via the MasterPhrase platform, consisting of providing tools and functionalities enabling foreign language learning using artificial intelligence (AI) technology, including the generation, presentation, and listening of educational content. The Service includes access to both free and paid functionalities as part of a subscription.
User - a natural person, a legal person, or an organizational unit without legal personality, using the MasterPhrase service.
Stripe - an external payment service provider.
ElevenLabs - an external audio service provider (Eleven Labs Inc.)
OpenAI - an external AI service provider (OpenAI Ireland Ltd)
GoogleAI - an external AI service provider (Google LLC)

The Service Provider provides the MasterPhrase platform, which enables foreign language learning supported by AI functions.
The MasterPhrase platform is available to all users, both natural persons and entrepreneurs.
The use of the platform is subject to the rules set out in the Terms of Service and the Privacy Policy.
The Service Provider reserves the right to introduce temporary technical breaks in the operation of the service, necessary for its maintenance or updates, of which Users will be informed in advance.
Upon commencing the use of the service, an agreement for the provision of electronic services is concluded between the Service Provider and the User.
The User may terminate the use of the services at any time by deleting their account. Deleting the account is equivalent to terminating the agreement for the provision of electronic services.

The use of the MasterPhrase platform requires registration and the creation of a user account.
The User is obliged to provide true and current data during registration.
The User is responsible for the security of their account, including maintaining the confidentiality of login details.
The User bears full responsibility for actions taken using their account.
The User may delete their account at any time through the function available in the account settings or by contacting the Service Provider.
It is forbidden to transfer login details to third parties.
The Service Provider may block or delete a User's account in the event of a violation of the Terms of Service or legal regulations.

The MasterPhrase platform is available in a free and subscription-based model. Details regarding fees and subscription plans are available on the pricing page.
The User may cancel the subscription at any time, which results in the termination of the service at the end of the current billing period.
All prices presented on the website are given in EURO (EUR) and include VAT (23%).
Payments are processed through the Stripe system, in accordance with the regulations of this operator.
A User who is a consumer has the right to withdraw from the contract within 14 days of its conclusion, provided that they have not started using the paid services during this period.
Subscription settlements are made cyclically, according to the billing period selected by the User.
The User agrees to the issuance and sending of invoices in electronic form to the e-mail address provided in the user account.

The Service Provider makes every effort to ensure that the MasterPhrase platform operates correctly and without interruptions.
The Service Provider is not liable for errors resulting from the operation of external service providers: OpenAI, GoogleAI, ElevenLabs.
The Service Provider is not responsible for interruptions in the operation of the service caused by force majeure, hardware failures, or external software.
To the extent permitted by law, the Service Provider is not liable for indirect damages, lost profits, or loss of User data.
The Service Provider is not liable for data loss if it was caused by force majeure or the User's negligence.
The Service Provider does not guarantee that the User will achieve specific educational results in connection with the use of the platform.

The administrator of the Users' personal data is the Service Provider.
Detailed information on the processing of personal data, including the purposes, legal bases, and rights of the User, is contained in the Privacy Policy.

The Service Provider reserves the right to make changes to the Terms of Service. Users will be informed of any changes in advance.
In matters not regulated by these Terms of Service, the provisions of Polish law shall apply, in particular the Civil Code and the Act on the provision of electronic services.
Changes to the Terms of Service come into force on the date specified by the Service Provider, not shorter than 7 days from the date of their publication.
The User has the right to terminate the contract before the new provisions of the Terms of Service come into force.
Any disputes arising from the use of the service will be settled by the court competent for the registered office of the Service Provider, with the reservation that for consumers, the court's jurisdiction is determined in accordance with the provisions of the Code of Civil Procedure.
The Terms of Service are made available to Users free of charge in a form that allows them to be obtained, reproduced, and recorded by means of the ICT system used by the User.

All materials made available within the MasterPhrase platform, including content generated by AI systems, are protected by copyright.
The User may use them only for their own personal use for educational purposes.
The User is responsible for the content they independently enter into the service.
The Service Provider reserves the right to remove content that is contrary to the law, good practice, or these Terms of Service.
The User grants the Service Provider a non-exclusive, royalty-free license to use the content they have posted to the extent necessary for the proper functioning of the platform.
Content generated by AI systems is for auxiliary and educational purposes. The Service Provider does not guarantee its full correctness or adequacy.
